Terms of Service

1. Operator and agreement

ForgeUI is operated by Scott Forster, a New Zealand sole trader trading as ForgeUI. By creating or using a ForgeUI account, you agree to these Terms and the Acceptable Use Policy, and acknowledge the Privacy Policy. If you do not agree, do not create or use an account.

ForgeUI Hosted Studio is live and publicly available. You may create an account online and purchase Hosted access through ForgeUI's live online checkout, subject to these Terms and the applicable Hosted Access Terms.

2. The service

ForgeUI provides visual tools for designing embedded interfaces, managing Hosted projects and assets, using AI-assisted features, and exporting native LVGL and ESP-IDF project output. Firmware build, flash, integration, testing and deployment remain the user's responsibility.

ForgeUI may change, add or remove service features and limits. Material policy changes will use a new policy version or effective date.

3. Accounts and security

You must provide a usable email address, keep account details accurate, protect credentials and recovery material, and promptly report suspected unauthorized access. Hosted content requires an active, verified account. You are responsible for activity performed through your account unless applicable law requires otherwise.

4. Projects, assets and exports

You retain responsibility for projects and assets you upload, create or export. You must have the rights needed to use submitted content. Review, test and validate generated code, firmware, UI output and hardware behaviour for your intended application. ForgeUI does not promise that output is automatically safe, error-free, production-ready or suitable for every device, safety-critical use or regulatory environment.

5. AI-assisted services and output

AI features may process prompts and project context through third-party providers. Output may be inaccurate, incomplete or non-unique, and similar output may be generated for others.

You may use ForgeUI-generated output in personal and commercial projects. ForgeUI does not claim ownership of your project or generated output merely because ForgeUI tools produced or assisted with it. ForgeUI does not guarantee copyrightability, exclusivity, or freedom from third-party intellectual-property claims. You must review output before using, publishing, manufacturing, selling or distributing it.

6. AI Credits and payments

AI Credits are governed by the AI Credit Terms. Purchases and payment remedies are also governed by the Refund Policy. Displayed prices and operation costs may change for future purchases or future AI operations; changes do not convert an existing credit balance into money.

ForgeUI is not currently registered for New Zealand GST. ForgeUI does not represent displayed prices as including New Zealand GST or issue GST tax invoices as a GST-registered supplier.

7. Availability and third-party services

ForgeUI depends on hosting, payment, email, analytics and AI providers. The service may be interrupted for maintenance, provider failure, security response or circumstances outside reasonable control. No uptime level is promised unless ForgeUI expressly agrees otherwise in writing.

8. Suspension, termination and closure

ForgeUI may restrict or suspend access where reasonably necessary for security, unlawful use, policy breach, non-payment, service protection or legal compliance. You may request account closure through Support. Use remaining credits before requesting closure: unused AI Credits are forfeited and are not transferable on closure, subject to any remedy required by law.

ForgeUI may retain financial, transaction, fraud-prevention, security, audit or other records where reasonably necessary or legally required after other account or project data is deleted or anonymized.

9. Warranties and liability

To the maximum extent permitted by law, ForgeUI is provided on an “as available” basis without warranties not expressly stated in these Terms. ForgeUI is not liable for indirect or consequential loss, lost profit, lost opportunity, or loss caused by a user's failure to review, back up, integrate or test output, except where liability cannot lawfully be excluded or limited.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot be excluded under applicable consumer or other law. Customers may have mandatory rights in New Zealand or their own jurisdiction.

10. Governing law and contact

These Terms are governed by New Zealand law, without overriding mandatory rights that apply to a customer elsewhere. Contact forgeui.esp32@gmail.com with account or service questions.
